The Issue

Innovators - Innovators who turn their dreams into designs and build ingenious new digital technologies and services. They are software designers and hardware engineers, college kids and garage inventors. They can also be artists who reuse and bring new meaning to existing works through mash-ups and re-mixes. In today’s litigious environment, many innovators must run a gauntlet of potential lawsuits that threatens to stop new inventions in their tracks. Often these lawsuits are brought by established interests who wish to lock out incumbents and preserve legacy business models. Even if the lawsuits have no legal basis, the massive cost of litigation is enough to bankrupt innovators before they can take their products to market. Artists - Artists include musicians, photographers, film-makers, authors, and all other creative individuals who rely on digital technologies to create and distribute new works of art. Thanks to digital technology, artists now include regular consumers who post their pictures, upload their videos, and make their music available over the internet. Some large content companies are attempting to impose government design restrictions on the technologies that make digital creation and distribution possible. Should these restrictions go into effect, artists will be denied access to new technologies and delivery systems and forced to rely on the big labels and studios to produce and distribute their work. Consumers – Ordinary consumers are not pirates. They merely want to enjoy their lawfully acquired content wherever, whenever and however they choose. Some big content companies see every consumer as a potential pirate, and want to limit consumer choices and access to technology. They need to understand that enjoying lawfully acquired music and video on your own time, in your own place and in your own way is not piracy-it's freedom. |

Digital technologies allow everyone the freedom to be artists, innovators, producers and creators, and to listen, watch, and participate wherever, whenever and however they choose. That freedom must be protected and nurtured.
